Everyday Hero CPR LLC

These Terms & Conditions ("Terms") are a binding agreement between you and Everyday Hero CPR LLC, a Texas limited liability company ("Everyday Hero CPR," "we," "us," or "our"). They govern your use of the Site and your registration for or participation in any class, skills check, private session, onsite or group training, or related service we provide.
By registering, purchasing, attending, or using the Site, you agree to these Terms. If you act for a business, school, agency, employer, parent or guardian, or other organization, you represent that you have authority to act for that person or organization.
Our Privacy Policy explains how we handle personal information and is available at everydayherocpr.com/privacy/.
Everyday Hero CPR provides CPR, AED, First Aid, Basic Life Support (BLS), Advanced Cardiovascular Life Support (ACLS), Pediatric Advanced Life Support (PALS), and related certification, renewal, instructor, blended-learning, and skills-check services. Services may be offered at our Richardson training center, at another location shown in the booking confirmation, at a client's site, or as a private one-on-one session.
Courses may be offered under standards of the American Heart Association (AHA), Health & Safety Institute programs including ASHI and MEDIC First Aid, the American Red Cross, Everyday Hero Academy, or another organization expressly identified at registration. Course format, certifying organization, location, prerequisites, and included materials are those shown in the applicable listing, quote, or confirmation.
A student under 18 must be registered by a parent or legal guardian, school, employer, or other authorized adult. Some courses or certifying organizations may impose additional age, prerequisite, identification, licensing, or professional-status requirements. Those requirements will be identified for the course when applicable.
Training is physically active and may require kneeling, bending, performing compressions on a manikin, delivering ventilations, and using the hands and arms for sustained periods. Tell us before class if a disability, injury, pregnancy, medical condition, religious consideration, or other circumstance may require an accommodation. We will make reasonable efforts to help, but we cannot waive a skill or completion standard imposed by a certifying organization.
You are responsible for determining, with advice from your healthcare provider when appropriate, whether participation is suitable for you.
Public classes and skills checks may be booked through the Site or our scheduling platform. Onsite, group, and private sessions may be arranged directly with us. A booking is confirmed only when we accept it and any payment due at booking has been received.
You must provide complete and accurate registration information, including the student's legal name and the email address to be used for the certification record. You are responsible for reviewing the course type, certifying organization, prerequisites, date, time, and location before confirming the booking.
Seats and instructor availability are limited. We may close registration, maintain a waitlist, or decline a booking when capacity, prerequisites, safety, payment, or course requirements are not satisfied.
Prices are stated in U.S. dollars and may change before a booking is confirmed. The price in the accepted booking, written quote, or invoice controls. Applicable taxes, travel charges, manuals, online-course components, card fees, or other charges will be disclosed before they are charged.
Payment may be required in full online at booking, accepted at the door or on the day of class when we expressly offer that option, or invoiced to a business, school, clinic, agency, or other organization. A seat or date is not guaranteed until any required payment or accepted purchase authorization is received.
An organizational invoice is due on the date shown on the invoice. Any deposit, installment schedule, cancellation charge, travel charge, minimum booking amount, or other group-specific term must appear in a written quote, invoice, or confirmation accepted before the service. We do not add an undisclosed late fee.
Card payments are processed by a third-party payment provider. We do not intentionally store complete payment-card numbers on our systems.
You may cancel or request rescheduling at least 24 hours before the scheduled class start time. If you cancel with at least 24 hours' notice, we will provide a full refund of the amount paid for that class, or, at your request and subject to availability, transfer the payment to another class.
A cancellation or rescheduling request received less than 24 hours before the start time, a failure to attend, or a late arrival that prevents completion of required content is not refundable. We may offer a transfer or credit in our discretion, but we are not required to do so.
Unless an accepted written quote or confirmation states different cancellation terms, the same 24-hour policy applies to group and onsite bookings. A written quote may state a different deadline, deposit, minimum charge, final-headcount date, or travel charge because an instructor, equipment, and travel time are reserved specifically for the group. The written term must be disclosed and accepted before the booking is confirmed.
Refunds are issued to the original payment method or as a credit to the responsible organization. Posting time depends on the bank, card issuer, or payment provider.
Arrive on time and attend the full course. If you arrive after required instruction or testing has begun, the instructor may determine that you cannot safely or validly complete the course and may require rescheduling under Section 6.
Certification requires attendance, participation, and satisfactory completion of every required written, online, and skills component. Attendance by itself does not guarantee certification. If a student does not meet the applicable standard, we cannot issue the certification, and the fee is not refundable solely because the student did not pass or complete the requirements.
We may cancel, reschedule, relocate, change instructors, or combine a class because of enrollment, instructor availability, weather, facility conditions, safety, equipment, or events outside our reasonable control. If we cancel and cannot offer a reasonable alternative, we will refund the amount paid to us for the affected class.
To the extent permitted by law, that refund is our responsibility for the cancellation. We are not responsible for travel costs, lost wages, missed employer or licensing deadlines, or a lapse in certification. Please schedule training early enough to account for possible changes.
The booking organization must provide a safe and reasonably accessible training space suitable for the confirmed group size, including clean floor space for manikin practice, appropriate seating and tables, lighting, power, parking or loading access, and any display surface identified in the quote. The host must disclose site rules, access restrictions, security procedures, and known hazards before the session.
The host is responsible for the premises and for providing an accurate final headcount by the requested date. Any minimum charge, travel area, travel fee, or site-specific requirement is valid only if stated in the accepted written quote or confirmation.
After a student successfully completes all requirements and we receive the information needed to process the record, we submit or issue the certification through the organization identified for the course. Delivery method and timing depend on that organization and may involve a digital card sent to the email address provided at registration.
The certifying organization determines the card's validity period, renewal rules, correction process, and any replacement fee. You are responsible for monitoring expiration and renewing on time. Renewal reminders are a courtesy and are not guaranteed.
We do not control whether an employer, school, licensing board, regulator, or other third party accepts a particular course or certification. Confirm the required course and certifying organization before registering. A fee is not refundable merely because the customer selected a certification that a third party does not accept.
Training materials and instruction are educational. They are not medical diagnosis, treatment, or individualized medical advice. Completing a course does not authorize anyone to act beyond applicable training, licensure, scope of practice, protocols, or law.
In an actual emergency, call 911 or the appropriate emergency service and follow applicable law and professional protocols. A student's decision whether and how to act in a real emergency remains that person's responsibility.
CPR and first-aid training involves physical activity and ordinary risks such as muscle strain, joint discomfort, fatigue, or contact with training equipment. By participating, you acknowledge those inherent risks and agree to follow instructor directions, use equipment only as instructed, and stop and notify the instructor if you feel unsafe or unwell.
Students must act respectfully and safely. We may refuse admission to or remove a person who is disruptive, threatening, abusive, under the influence of drugs or alcohol, damaging equipment, or unwilling to follow safety or course instructions. A removal for serious misconduct is not refundable.
Nothing in these Terms releases us from liability that cannot lawfully be waived, including liability arising from gross negligence or willful misconduct.
We will obtain separate permission before using an identifiable student's photograph, video, voice, testimonial, or likeness for advertising or promotional purposes. Permission for a minor must come from an authorized parent or legal guardian. Declining promotional-media permission does not affect eligibility to attend a class.
Students may not record, reproduce, or distribute a class, presentation, test, manual, video, or other course content without prior written permission from Everyday Hero CPR and any applicable rights holder.
Everyday Hero CPR may send non-marketing texts about inquiries, class confirmations, appointments, schedule or location changes, cancellations, instructor details, and certification reminders. If you provide separate marketing consent, we may also send occasional class announcements, offers, or promotions. Consent for one program does not automatically enroll you in the other.
You authorize text messages only through a permitted opt-in method described in our Privacy Policy and the consent disclosure presented when you enroll. Website and electronic consent choices are optional, unchecked, and separate for marketing and non-marketing messages. Marketing consent must be written or electronic; verbal requests are used only for documented non-marketing messages.
Consent to receive text messages is not a condition of purchasing any product or service. Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
You can cancel the SMS service at any time. Reply STOP to any message or text STOP to 469-298-9593. After we receive STOP, we may send one confirmation message and will then stop the messages covered by your request. To join again, complete a new opt-in in the same manner you originally enrolled.
For assistance, reply HELP or contact francisco@everydayherocpr.com or 469-298-9593. You may also use another reasonable method to tell us to stop. Questions about privacy and mobile information are addressed in our Privacy Policy.
No mobile information is shared with third parties or related entities for their own marketing or promotional purposes. Messaging subcontractors may process information only as necessary to provide support services. Text-message opt-in data and consent are not shared with third parties.
We may email you about bookings, classes, certifications, payments, accounts, or inquiries. Marketing email is sent only in accordance with the choices we present. You may unsubscribe from marketing email using the link in the message or by contacting us; transactional email about an existing booking or request may continue.
The Site, our name and logo, and materials created by Everyday Hero CPR are owned by us or licensed to us and are protected by intellectual-property laws. You may use Site content for personal reference but may not copy, publish, sell, scrape, or commercially exploit it without written permission.
Materials created by the AHA, HSI, ASHI, MEDIC First Aid, the American Red Cross, Everyday Hero Academy, or another provider remain the property of their respective owners and are subject to their license terms.
You may not interfere with Site operation, bypass access controls, introduce malicious code, impersonate another person, or use the Site or services for an unlawful purpose.
The Site may link to or embed class scheduling, payment, certification, online-learning, equipment-retail, and other services we do not control. Their terms and privacy practices apply when you use them. We are not responsible for an external site's content, availability, products, or practices.
Some external retail links may result in Everyday Hero CPR receiving a commission if a purchase is made. This does not change the price paid. We do not provide customer phone numbers or SMS consent records to those retailers.
We provide training and the Site in good faith and with reasonable care and skill. Except for warranties that cannot be excluded by law and any express written commitment in a booking, the Site and services are provided without additional express or implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Site will be uninterrupted, that every scheduled class will proceed unchanged, that a certification will be accepted by every third party, or that training will prevent or improve the outcome of an emergency.
To the fullest extent permitted by law, neither Everyday Hero CPR nor its owners, employees, contractors, or instructors will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost wages, lost business, lost data, or loss of an employment or certification opportunity arising from the Site, a class, or these Terms.
To the fullest extent permitted by law, our aggregate liability for a claim arising from a purchased service will not exceed the amount paid to us for the service giving rise to the claim. This limitation does not apply to refunds expressly promised in these Terms, personal injury caused by our negligence, gross negligence or willful misconduct, or any liability that applicable law does not permit us to limit.
You are responsible for loss or damage directly caused by your material breach of these Terms, unlawful conduct, intentional misuse of the Site or equipment, or knowing misrepresentation. An organization hosting onsite training is also responsible for claims caused by unsafe premises or hazards it knew about and failed to disclose.
Any duty to reimburse or defend another party applies only to the extent permitted by law and in proportion to the responsible party's conduct. This Section does not require a consumer to indemnify us for our own negligence or wrongdoing.
Please contact us first about a dispute and allow 30 days for a good-faith informal resolution, unless immediate action is reasonably necessary or law provides a shorter deadline.
Texas law governs these Terms, without regard to conflict-of-law rules. Any court proceeding must be brought in a court with proper subject-matter jurisdiction, personal jurisdiction, and venue under applicable law. Nothing in these Terms prevents either party from using a court of competent jurisdiction for a qualifying small-claims matter or seeking appropriate emergency relief.
We may update these Terms by posting a revised version and updating the date at the top. The version accepted when a booking is confirmed governs that booking unless a later change is required by law or both parties agree otherwise. Material changes will apply prospectively unless law permits otherwise.
